EXEMPTION FROM PARAGRAPHS 7.8.5(a) AND 7.6.8(a) OF THE FLIGHT ATTENDANT TRAINING STANDARD AND CLAUSE 705.124(2)(b)(iv)(C) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Air Canada P.O. Box 14000, Saint-Laurent, Québec H4Y 1H4 from the requirement of Paragraphs 7.8.5(a)(Initial) and 7.6.8(a)(Annual) of the Flight Attendant Training Standard (TP 12296) made pursuant to clause 705.124(2)(b)(iv)(C) of the Canadian Aviation Regulations (CARs), that an air operator require the wearing of Protective Breathing Equipment (P.B.E.) during the live fire fighting drill, subject to the conditions set out below.

PURPOSE

The purpose of this exemption is to allow Air Canada to conduct its live fire fighting training without the requirement for each trainee to wear protective breathing equipment (P.B.E.). 

APPLICATION

This exemption is applicable only to Air Canada’s Live Fire Fighting Training Programs.

CONDITIONS

This exemption is subject to the following conditions:

  1. Air Canada shall ensure each trainee wears a P.B.E. during the cabin fire fighting drills required by Initial, Sections 7.8.6 and 7.8.7 of the Flight Attendant Training Standard.
  2. Air Canada shall ensure each trainee wears a P.B.E. at least once every three years, during the cabin fire fighting drills required by Annual, Sections 7.6.4 and 7.6.5 of the Flight Attendant Training Standard.
  3. Air Canada shall amend its flight attendant training programs to include conditions 1 and 2.
  4. Air Canada shall submit its amended flight attendant training programs for approval in accordance with paragraph 705.124(1)(b) of the CARs.

VALIDITY

  1. This exemption is in effect until the earliest of: September 01, 2006; 23:59 EST
  2. the date on which the exemption is superseded by an amendment to the Canadian Aviation Regulations or its associated standards;
  3. the date on which any of the conditions set out in this exemption is breached; or
  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.

CANCELLATION:

The exemption from paragraphs 7.8.5(a) and 7.6.7(a) made pursuant to clause 705.124(2)(b)(iv)(C) of the Canadian Aviation Regulations issued to Air Canada on September 8th, 2000 at Ottawa, Ontario, Canada by the Director of Commercial and Business Aviation on behalf of the Minister of Transport is hereby cancelled because it is the opinion of the Minister that it is no longer in the public interest or is likely to affect aviation safety.
